MyDx, Inc. Privacy Policy

Your privacy is important to us. MyDx, Inc. (“MyDx”) has created the following Privacy Policy to let you know what information we collect when you visit www.mydxlife.com(the “MyDx Site” or “Site”), why we collect it and how it is used. This Privacy Policy is governed by our Terms of Use. By using the MyDx Site, you agree to this Privacy Policy. This is our entire and exclusive Privacy Policy and it supersedes any earlier version. We may change this Privacy Policy by posting a new version of this Privacy Policy on this Site, which it is your responsibility to review.

Personally Identifiable Information

“Personally Identifiable Information” means any information that may be used to identify an individual, including, but not limited to, a first and last name, home or other physical address, an email address, phone number or other contact information, whether at work or at home. MyDx may ask to collect Personally Identifiable Information from you when you use the MyDx Site. MyDx also automatically receives and records information on our server logs from your browser, including your IP address, cookie information and the page you request. It is always your choice whether or not you provide us with your Personally Identifiable Information; however, a decision to withhold Personally Identifiable Information may restrict or prevent us from providing you with a particular product or service.

Limiting Use, Disclosure and Retention

Our collection of Personally Identifiable Information is limited to what is reasonable under the circumstances, and your information will be used for the purpose for which it was collected, or when it is required or permitted by law. We may inform you about products and services by mail, e-mail, text message, telephone, or other means. If you do not wish to receive direct marketing, contact us and tell us that you do not wish to be contacted in a particular manner.

Third-Party Service Providers

We employ other companies and individuals to perform functions on our behalf. Examples include fulfilling orders, delivering packages, sending postal mail and e-mail, analyzing data, providing marketing assistance, providing search results and links (including paid listings and links), processing credit card payments, and providing customer service. They have access to Personally Identifiable Information only to the extent needed to perform their functions, but may not use it for other purposes. By providing your Personally Identifiable Information to MyDx in order to obtain MyDx products or services, you acknowledge and agree that disclosure of your Personally Identifiable Information to such third parties may be necessary to provide you with such products and services, and you hereby consent to such disclosure.

Sharing and Disclosing Information

Other than as expressly set forth herein, MyDx does not rent, sell or share personal information it collects about you to or with third parties. Information collected from you is only used to complete and support your purchases from and use of the MyDx Site and to comply with any requirements of law. However, MyDx may disclose Personally Identifiable Information if required to do so by law or in the good faith belief that such action is necessary to: (1) conform to the edicts of the law or comply with legal process served on MyDx or the MyDx Site; (2) protect and defend the rights or property of MyDx; or (3) act in urgent circumstances to protect the personal safety of users of MyDx, its web sites or the public. If MyDx should ever file for bankruptcy or merge with another company, we may sell the information you provide to us on the MyDx Site to a third party (in the case of bankruptcy) or share your Personally Identifiable Information with any company with whom we merge – in such situations, MyDx will require, to the best of its ability, the purchasing or merging party to comply with all confidentiality and privacy requirements as set forth herein respecting your Personally Identifiable Information.

MyDx may combine your information with other information into an aggregate form, so your information no longer personally identifies you. We may then disclose the aggregate information to third parties, so they can obtain an overall picture of MyDx’s products, services, customer usage patterns and/or other statistical information

Security of Information

MyDx will take reasonable precautions to maintain the confidentiality and security of your Personally Identifiable Information so that it is not disclosed to anyone outside our group of companies and our selected third party service providers/business partners without your consent, unless required by law or as otherwise set forth herein. Where possible, MyDx protects the security of your information during transmission by using Secure Sockets Layer (SSL) software, which encrypts the information you input.

International Transfers

Personal information collected on the MyDx site may be stored and processed in The United States or any other country in which MyDx or its affiliates, subsidiaries or agents maintain facilities, and by using the MyDx Site, you consent to any such transfer of information outside of your country.

Do we use cookies?

Yes (Cookies are small files that a site or its service provider transfers to your computers hard drive through your Web browser (if you allow) that enables the sites or service providers systems to recognize your browser and capture and remember certain information

We use cookies to help us remember and process the items in your shopping cart, understand and save your preferences for future visits, keep track of advertisements and compile aggregate data about site traffic and site interaction so that we can offer better site experiences and tools in the future. We may contract with third-party service providers to assist us in better understanding our site visitors. These service providers are not permitted to use the information collected on our behalf except to help us conduct and improve our business.

Children’s Online Privacy Protection Act Compliance

We are in compliance with the requirements of COPPA (Childrens Online Privacy Protection Act), we do not collect any information from anyone under 13 years of age. Our website, products and services are all directed to people who are at least 13 years old or older.

Maintenance of Personal Information

MyDx has established the following practices regarding the maintenance of your personal information.

If, for any reason, you wish to review your personal information that MyDx has in its possession, you can contact our Privacy Officer at info@mydxlife.com, who will be pleased to provide you with all your personal information that MyDx has on file.

Sometimes, it will be necessary for you to update your personal information MyDx has on file in order to maintain accuracy. For example, if you move or change credit cards, you may be required to update your information in order to keep receiving the products and services provided by MyDx. If you wish to make any changes or corrections to your personal information, please contact our Privacy Officer who will implement the changes. This will help us ensure our records are always up-to-date.

You always have the choice of whether you wish to receive information – such as e-mail updates – from MyDx. If you do choose to opt out of communications respecting products and services provided by MyDx, you may not obtain all the benefits we could otherwise provide, such as updates or warnings. MyDx will not have any liability to you for your loss of those benefits or any negative effects respecting your use of MyDx’s products or services.

A situation may arise where you desire to have all of your personal information that is contained in MyDx’s records deleted or destroyed. If this is what you wish, please contact our Privacy Officer, who will take care of removing your personal information from all of MyDx’s active records. However, there may be situations where we are obligated to retain one archival copy of your information to allow us to comply with laws or respond to legal processes, and there may be instances where we are unable to remove your specific information from our records for technical reasons. We will inform you of all such situations, and will only use your retained personal information to the limited extent necessary to comply with such laws or respond to legal processes.

Compliance with Privacy and Data Security Laws

MyDx complies at all times with all applicable state and federal laws regarding the collection, retention, use and protection of all personal information, including Personally Identifiable Information.

Collection of Personal Information

As a visitor to the Site, you can engage in many activities without providing any Personal Information.

However, when you register to use our site and order products or services as a MyDx subscriber in order to provide the services to you, we may collect the following Personal Information from you:

  • Contact information such as your name, phone number, primary address, and email address.
  • Billing information such as the number, expiration date, card type and billing address of your credit card;
  • Demographic information such as your job title, job description and company name and company type; and
  • Profile data, including your username and password, details about your purchases and the Content that you license from us.

Depending upon the activity, some of the information that we ask you to provide is identified as mandatory and some as voluntary. If you do not provide the mandatory data with respect to a particular activity, you will not be able to engage in that activity.

As is true of most websites, when you use the Site, MyDx or third party subprocessors contracted by MyDx may also collect certain technical and routing information about your computer to facilitate your use of the Site and its services. For example, we may log environmental variables, such as browser type, operating system, CPU speed, and the Internet Protocol (IP) address of your computer. We use these environmental variables to facilitate and track your use of the Site and its services. MyDx also uses such environmental variables to measure traffic patterns on the Site. To better understand the needs of our visitors to the Site we may occasionally match such information with your Personal Information.

In order to reduce errors in our database, authenticate our users, and prevent abuse of our system, we may on occasion supplement the Personal Information you submit to us with information from third-party sources. For example, we may supplement your contact information with address information provided by the U.S. Postal Service to qualify your information and prevent errors in our database. We may supplement the information that we collect directly from you with information stored in third-party databases, such as demographic information or company information in order to make it more likely that any marketing communications we send will be relevant and of interest to you. When you download and use our Mobile Apps or Services, we automatically collect information on the type of device you use, and operating system version. We do not ask for, access or track any location-based information from your mobile device at any time while downloading or using our Mobile Apps or Services.

Updating Your Personal Information and Privacy Preferences

Upon request MyDx will provide you with information about whether we hold, or process on behalf of a third party, any of your personal information. To request this information please contact us at info@mydxlife.com.

You have the right to access and correct, or delete your Personal Information and privacy preferences at any time. This may be accomplished by clicking on the update subscription preferences, where you can view and make changes to most of your Personal Information immediately. For security purposes, certain Personal Information can only be changed by contacting support. We will respond to your request promptly within a reasonable timeframe.

How Your Personal Information Is Used

MyDx collects your information in order to provide services to you, comply with our legal obligations, and to improve our products and services. We do not sell, rent or share your personally identifiable information to or with third parties in any way other than as disclosed in this Privacy Policy. MyDx may use this information to:

  • Process your financial transactions.
  • Send you order / renewal confirmations.
  • Register your rights, if any, to technical support or other benefits that may be made available to registered users.
  • Respond to customer service requests, questions and concerns.
  • Administer your account.
  • Send you requested product or service information.
  • Keep you informed about special offers and services of MyDx and selected third parties.
  • Administer promotions and sweepstakes you enter and notify you of the results.
  • Investigate, prevent or take action regarding illegal activities and/or violations of our Terms of Service.
  • Meet our research and product/service development needs and to improve our Site, services and offerings; and
  • Customize your experience, including targeting our services and offerings to you.

We store information that we collect through cookies, log files, transparent images, and/or third party sources to create a summary of your preferences. We tie your personally identifiable information, and/or your membership usage history, to information in the summary, in order to provide tailored promotions and marketing offers, to improve the content of the site for you and/or to determine your preferences.

In certain situations, MyDx may be required to disclose personal data in response to lawful requests by public authorities, including to meet national security or law enforcement requirements.

Where required by law (e.g., to comply with a subpoena, warrant, court order, or legal process served on MyDx), and when we believe that disclosure is necessary to protect our rights, avoid litigation, protect your safety or the safety of others, investigate fraud, and/or respond to a government request. We may also disclose information about you if we determine that such disclosure should be made for reasons of national security, law enforcement, or other issues of public importance.

Conditions of Use, Notices, and Revisions

If you choose to visit the MyDx Site, your visit and any dispute over privacy is subject to this Privacy Policy and our Terms of Use, including limitations on damages, resolution of disputes, and application of the law of the state of California. If you have any concern about privacy at the MyDx Site, please contact us with a thorough description and we will try to resolve it. Descriptive headings are for convenience only and shall not control or affect the meaning or construction of any provision of this Agreement. Our business changes constantly, and our Privacy Policy and Terms of Use will change also. Please check back frequently to see recent changes.
